U.S. federal judge Andrew Carter ruled that Binance cannot compel plaintiffs to arbitrate losses from purchasing unregistered tokens, because Binance failed to adequately notify users of changes in its terms of service regarding arbitration and the waiver of class action rights, rendering the clause ambiguous and unenforceable. The ruling allows customers to file claims in court for losses incurred before February 20, 2019. Tokens involved include ELF, EOS, FUN, ICX, OMG, QSP, and TRX.
